Stands
before you Michael E. DiRosa, a Citizen of the State of Louisiana,
unschooled in the law, with an emergency application for a judicial
determination of my continuous, timely and repeated objections to the
abhorrent conduct of William K. Suter, Clerk of the United States
Supreme Court.
It shall
be known that I write this emergency application from prison,
awaiting my next executioner. I have been abandoned in this prison,
absent charge and trail, by the State of Louisiana and have been left
to die in the next natural or man made disaster for I am forbidden
the use of any device with which I may flee for my life and my
emergency evacuation vehicle has been stolen by the State of
Louisiana. I have already bested my last three executioners,
hurricanes Katrina and Rita and the failure of our levies with
resulting flood. Plus, In the time that Mr. Suter has taken to
intentionally violate my rights, two more category 5 hurricanes have
formed and hit land, killing many. Time is of the essence as my next
executioner may come at any time.
On the
9th day of July, 2007 I did mail a valid complaint, with
supporting documents, instituting an original action in the Supreme
Court of the United States under Article III Section 2 of the United
States Constitution, among other grounds, against the above named
defendants.
In that
valid complaint I did claim, backed by positive and irrefutable
evidence and proof, that citizens of a state foreign to the State of
Louisiana had, in conspiracy, overthrown the government of the State
of Louisiana and did make it illegal for any Citizen of the State of
Louisiana to hold any Statewide elective office, to include the
Governor, the Attorney General, and the Louisiana Supreme Court,
among others. This fact is confessed to be true, by the State of
Louisiana, in Article IV Section 2 of the Louisiana State
Constitution, among others.
I did
further claim, backed by positive and irrefutable evidence and proof,
that the State of Louisiana did steal, without compensation nor due
process, by illegal bill of credit, every vehicle in the State of
Louisiana, including bicycles and ridden animals. This fact is
confessed to be true, by the State of Louisiana, in Article VII
Section 5 of the Louisiana State Constitution, among others. Not
only did the State of Louisiana steal all vehicles, it did
intentionally hide the evidence of the theft. This fact is confessed
to be true, by the State of Louisiana, in Louisiana Constitution
Ancillary Article 19 Section 19.
Furthermore,
I did claim, backed by positive and irrefutable evidence and proof,
that the State of Louisiana did steal these vehicles for the
expressed purpose of stealing my right to travel in pursuit of
happiness. This fact is confessed to be true, by the State of
Louisiana, in Louisiana Revised Statute 32:25.
Having
stolen every “device
by which persons or things may be transported upon a public highway
or bridge.” La R.S. 32:1(92), the State of Louisiana did
create a body corporate known as the Department of Public Safety and
Corrections as its corporate alias. The State of Louisiana did then
mandate that everyone “voluntarily” become bound to
service for a term of years to this body corporate and any
corporation in the insurance industry or be confined and abandoned in
a prison who's bounding wall is the distance that you can walk in a
day, carrying your possessions on your person or in a push cart,
until death or submission to the invading army. Citizens of the
State of Louisiana are forbidden even to own or operate an emergency
evacuation vehicle and, hence, forbidden to flee for one's life from
natural and man made disasters. This prison, which I have termed
walking distance prison could, just as accurately, be called death
row. I now endure this prison.
As my
complaint and supporting documents do more completely show and prove,
the State of Louisiana has stolen virtually every right, alienable
and unalienable, this government was created to protect, including
my right to exist as a Human Being.
On the
13th day of July, 2007, M. Blalock did, in Mr. Suter's
name, return these documents to me informing me that these documents
did not conform to the rules of this Court. The returned Documents
were received by me on the 16th day of July, 2007. This
letter is attached to the first objection to the return of legally
filed documents.
On the
23rd day of July I did return these legally filed
documents with an objection to their return. In this objection I did
supply reasoned argument, backed by law, showing conclusively that
these documents did indeed comply with the rules of this Court, as
much as was possible from this prison, and
did demand a judicial ruling on my objection.
On the 31st day of July, 2007 I did, again,
receive my legally filed complaint and objection to their first
return. When these documents were sent from the Clerk's office I can
not determine as there is no postmark that I can find and the cover
letter was only a copy of the July 13th letter.
On the 3rd day of August, 2007, after almost
an extra month of imprisonment, I did, yet again, return my original
complaint with the supporting documents with a second objection to
their illegal return and did again demand a judicial ruling on my
objection. I did send these documents addressed to Mr. Suter
personally and did include a cover letter to Mr. Suter demanding that
he stop violating my rights and to stop illegally ruling on the
sufficiency of my documents and did demand, again, a judicial ruling
on my timely and continuous objections backed by law. This letter is
attached to the second objection to the return of legally filed
documents.
On the 21st day of August, 2007 Jeffrey
Atkins, in Mr. Suter's name, did return my legally filed documents
which I did not receive until Sunday, the 26th day of
August, 2007 when I found the documents on the doorstep exposed to
the elements.
Now Mr. Suter has abandoned his judicial ruling on the
sufficiency of the documents, and does now claim that, in his illegal
adjudgment, that I have no right to redress of grievance in this, or
any court, and does cite Hans v. Louisiana, 124 U.S. 1 (1890).
I have
told Mr. Suter, in no uncertain terms, that my life is in imminent
peril and that I do and have continuously demanded a judicial
determination of my objections. Yet, despite my objections and
demands, he cites some fool in the wrong court. In point of fact,
his cite does confirm my standing in the United States Supreme Court.
Let me quote from HANS V. LOUISIANA
134 U.S. 1 (1890)
'It may be accepted as a point of
departure unquestioned,' said Mr. Justice MILLER in Cunningham v.
Railroad Co., 109
U.S. 446, 451, 3 S. Sup.
Ct. Rep. 292, 'that neither a state nor the United States can be sued
as defendant in any court in this country without their consent,
except in the limited class of cases in which a state may
be made a party in the supreme court of the United States by virtue
of the original jurisdiction conferred on this court by the
constitution.' HANS V.
LOUISIANA 134 U.S. 1 (1890) [emphasis added]
Mr.
Suter has also failed to notice that, in Hans v. Louisiana, it was
the Attorney General of the State of Louisiana that answered and not
the Clerk of Court. Mr. Suter, having proved that he believes
himself to be the Supreme Chief Justice of the Supreme Court of the
United States, does now believe that he is the State of Louisiana and
has a right to speak in its behalf. Is the Janitor of the Supreme
Court of the United States going to stand for the Department of
Public Safety and Corrections or is Mr. Suter going to wear that hat
too? Is he to also be the jury?
In fact,
Mr. Suter's adjudgment does strike at the very heart of my complaint.
Just how much Sovereignty is left to the State of Louisiana? Not
only has the State of Louisiana been taken over by citizens of a
foreign state who have enslaved or imprisoned Citizens of the State
of Louisiana, contrary to the contract with We, the People, but
also, by Article II
Section 26 of the Louisiana State Constitution it does appear that
Louisiana Sovereignty was also stolen by this invading army. This is
more fully discussed in the brief in support of complaint 4 and 5.
If Mr. Suter does wish to argue the merits of my
standing, cause of action, complaints and irrefutable proof, I
believe that Amicus Curiae is available to him. However, if summary
judgment does not issue from this Court based upon the positive,
irrefutable proof and confessions of the State of Louisiana and this
matter is set for trial, it is my current belief that he will be
named as one of the Conspirators where he will have ample opportunity
to discuss the merits of my case.
There can be no doubt that my cause of action and
standing are correct nor can there be any contention that my proof is
refutable as the State of Louisiana does confess the facts. The only
thing obstructing my guarantee of redress of grievance is the illegal
adjudgments and actions of William K. Suter, Clerk of the United
States Supreme Court.
I do now
apply to you directly in an attempt to unblock the ears of the Court
made deaf by the illegal actions of William
K. Suter, Clerk of the United States Supreme Court. A ruling is
required on my continuous and timely objections. No less than my
life is in imminent danger of forfeit as I languish in this dungeon
awaiting my next executioner for the heinous crime of demanding
specific performance on the contract with We, the People.
I have sent, for the fourth time, my complaint
instituting an original action in the Supreme Court of the Untied
States back to William K. Suter, Clerk of the United States Supreme
Court on the same day and time that I send this application (from
this prison a trip to the copy machine and post office is a major
undertaking fraught with danger. See Certificate of Service.) The
returning complaint will be accompanied by, now, three objections to
their illegal return. One can only hope that William K. Suter, Clerk
of the United States Supreme Court will not violate rule 22 of this
Court.
I do hereby apply to you to arrange for a judicial
determination to be rendered on my continuous, timely and oft
repeated objections to the abhorrent and illegal actions of William
K. Suter, Clerk of the United States Supreme Court. My life hangs in
the balance.

I, Michael E. DiRosa to hereby certify that I have,
again, due to the malicious acts of the clerk of court, had to risk
what little freedom I do still possess (enjoy is not an appropriate
word for my happiness is not here) and have had to openly and
notoriously defy the Tyrant and operate a self propelled motor
vehicle, commonly known as a bicycle (currently an infamous crime,)
and did endure the four hour journey to the copy machine and to the
United States Postal Authority, carrying the documents on my back.
(Were I to accomplish this task on foot, as is currently required by
law, I do estimate that the time required would be close to ten or
twelve hours.) I did then entrust to the United States Postal
Authority a copy of this document properly addressed to the parties
listed below, postage prepaid, certified mail, return receipt
requested.
