Comes
now into court Malinda Nicole DiRosa, a Citizen of the State of
Louisiana, appearing specially in proper person, unschooled in the
law, demanding all of her rights under the Constitution of the United
States and the Bill of Rights, to demand the PARTICULARS of the
above entitled actions.
If
anyone has any cause or reason to believe that I am not a Citizen of
the State of Louisiana, I demand that they bring their contention
forward so that I may denounce it as the fraud that it is. Surely it
can not be any affiliation with the Social Security administration
nor other affiliations as these affiliations have been forced upon me
at the point of a bayonet by the treasonous conspirators who have
overthrown the United States as confessed by the Louisiana Bar
Association in the Dubious origins of the 14th amendment.
Hence, all such organizations do not, in effect, exist as they were
created by an illegitimate government posing as the government of the
United States and therefore only pretend to exist under color of law.
In fact, there has been no valid treaty or law created since the
conspirators in congress overthrew congress and invaded and conquered
the Sovereign Citizens of the State of Louisiana.
This
alleged Defendant does, again, notice this court that it is acting
without jurisdiction. This alleged Defendant does, again, notice
this court that the Plaintiff has no cause of action, right of
action, nor standing in this matter and is, again, perpetrating a
fraud upon this court.
This
alleged Defendant does remind this court that she is still unaware of
the particulars of the charges against her and requires this
information before any hearing by this jurisdictionally deficient
court. However, if this jurisdictionally deficient court is going to
continue this illegal prosecution, this alleged Defendant has no
choice but to defend against these vile and malicious fraudulent
charges brought by agents of a foreign government.
It is
hereby demanded that the Plaintiff answer these questions, under
oath, or, in the alternative, that these fraudulent charges be
dismissed with prejudice certain and all record of these fraudulent
charges be expunged.
Is
the 26th Judicial Court a United States Court, a
Louisiana State Court or some other jurisdiction? In which
jurisdiction will I be standing?
In which type of court will I be standing? Is this
an admiralty, equity, common law, civil action or some other type,
or combination thereof, which has prompted these infamous charges
to be brought against me?
What exactly is the cause of action, standing and
right of action of the plaintiff?
What is the maximum penalty for the charges against
me, both individually and in combination?
Who or what is this entity known as the State of
Louisiana? This entity that in its own name and not in the name
of its people does prosecute me. This entity that drags me before
the Twenty-Sixth Judicial District Court on a mere bill of
information. Surely it can not be the Sovereign State of
Louisiana of the United States ? I do demand to know who is this
entity calling itself the State of Louisiana? Is it the Sovereign
State of the United States or is it some artificial entity created
or taken over by the treasonous conspirators? If bound to service
by treaty, cession, or compact, how is it so bound and how am I
bound? If such treaty, cession, or compact exists I do demand a
copy as all such treaties, cessions or compacts that have been
entered into by the treasonous conspirators while the Sovereign
Citizens of the State of Louisiana were unrepresented and their
interests uncared for.
If the Twenty- Sixth Judicial District Court is a
Federal Court, on what grounds does the State of Louisiana believe
that I should be prosecuted in a federal jurisdiction instead of a
State Jurisdiction?
If the grounds upon which the State of Louisiana does
prosecute me in a federal Court in the name of the State of
Louisiana and not in the name of the People of the State of
Louisiana is United States Code §
1251, then on what grounds does the State of Louisiana believe
that I am the citizens of another State or an alien? It is my
belief that I do maintain a bona fide residence in the State of
Louisiana and have, of my own volition, become a Citizen of the
State of Louisiana in accordance with the Slaughterhouse Cases 83
U.S. 36. Of what state does the State of Louisiana believe that
I am a citizen and on what basis does it so believe? If the State
of Louisiana does believe that I am an alien on what basis does it
so believe?
If my residence is not in the State of Louisiana, in
which state is it? By what treaty, compact, cession of land has
the territory or land mass of the State of Louisiana been
alienated and to whom or what has possession transfered? If such
treaty, cession, or compact exists I do demand a copy.
Is the current Governor a Citizens of the State of
Louisiana? If not, of what state is he a citizen and by what right
does a citizen of a state foreign to the State of Louisiana hold
this office?
Is the Attorney General of the State of Louisiana a
Citizen of the State of Louisiana? If not, of what state is he a
citizen and by what right does a citizen of a state foreign to the
State of Louisiana hold this office?
Is any member of the Legislative body of the State
of Louisiana a Citizen of the State of Louisiana? If not, of what
state are they a citizen and by what right does a citizen of a
state foreign to the State of Louisiana hold this office?
Is any congressional representative of the State of
Louisiana a Citizen of the State of Louisiana? If not, of what
state are they a citizen and by what right does a citizen of a
state foreign to the State of Louisiana hold this office?
Is any member of the Supreme Court of the State of
Louisiana a Citizen of the State of Louisiana? If not, of what
state are they a citizen and by what right does a citizen of a
state foreign to the State of Louisiana hold this office?
Is the Judge before whom I will stand a Citizen of
the State of Louisiana? If not, of what state is he a citizen?
Is the prosecutor in this matter a Citizen of the
State of Louisiana? If not, of what state is he a citizen and by
what right does he claim to stand for the State of Louisiana?
Does the prosecutor in this matter derive any power
or right to exist as a prosecutor from a state foreign to the
State of Louisiana? How is the prosecutor connected to the this
state foreign to the State of Louisiana?
Who is the Bossier Parish Sheriff and is he a
Citizen of the State of Louisiana? If not, of what state is he a
citizen and by what right does a citizen of a state foreign to the
State of Louisiana hold this office?
Who is the Bossier Parish Sheriff's Deputy that
arrested the alleged Defendant and is he a Citizen of the State of
Louisiana? If not, of what state is he a citizen?
By what power did the Bossier Parish Sheriff's
Deputy arrest this Citizen of the State of Louisiana? Why does
the prosecutor believe that a bill of information is sufficient to
institute the infamous charges against a sovereign Citizen of the
State of Louisiana? Why does the prosecutor believe that a grand
jury indictment was not necessary in this case?
Does any of the power or right to exist of the
Bossier Parish Sheriff derive from a state foreign to the State of
Louisiana ? How is the Bossier Parish Sheriff connected to this
foreign government?
Is there any connection between the Bossier Parish
Sheriff and the Department of Public Safety and Corrections? Does
the Bossier Parish Sheriff derive any of his power to act from the
connection, contract, grant of power or other such connection to
the Department of Public Safety and Corrections? If there is such
a connection I do demand a copy.
It is my contention that I am the owner of this
vehicle and that I have not violated any conditions of the owner
of the vehicle. If it is contended that I am not the owner of
this vehicle than who is claiming to be the owner of the vehicle
and by what right? I do demand that they prove their allegation
of ownership.
Why was the Public
Defender's office, 26th Judicial District served with
notice of the denial of the alleged Defendant's NOTICE AND DEMAND
FOR DISMISSAL FOR WANT OF JURISDICTION OF THE COURT AND LACK OF
CAUSE OF ACTION, RIGHT OF ACTION AND STANDING OF THE PLAINTIFF.
CONSTRUCTIVE NOTICE OF TREASON CONSPIRACY AND FRAUD.
Is there any Citizen of the State of Louisiana in
the Public Defender's office, 26th Judicial District.
If not, of what state are they citizens?
Is the Supreme Court of the United States the one
supreme court in which the judicial power of the United States
shall be vested created by Article III of the United States
Constitution or is it an inferior court created by Congress?
If the Supreme Court of the United States is an
inferior court created by Congress, what is the name and address
of the one supreme court in which the judicial power of the United
States shall be vested created by Article III of the United States
Constitution?
Is there any law, compact, treaty or other act that
would force this court to deny me any information on any of these
matters, if so what act? I do demand a copy of this/these acts.
Are there any laws that may have even prejudged the question, and
tied the courts down to decisions? If so I do demand to know
which laws and do demand a copy. “For I agree, that there is no
liberty, if the power of judging be not separated from the
legislative and executive powers." Publius The Federalist 78.
These questions can pose no difficulty to the doctors
of law that are fraudulently prosecuting this alleged Defendant. If
the prosecutors of these fraudulent charges and the Plaintiff can not
answer these simple questions, it shall be and must be construed as
prima facia evidence that these charges are fraudulent and that the
entity pretending to be the State of Louisiana and all representing
the entity pretending to be the State of Louisiana have fraudulently
brought these infamous charges against me. If they have nothing to
hide, let them hide nothing.
This alleged Defendant does again notice this court
that any appearance in the court on the 8th day of July,
2009 is only to fulfill the bond requirements and is in no way to be
construed as a grant of jurisdiction. This alleged Defendant always
has, and still does challenge the jurisdiction of this court, the
right of action, cause of action and standing of the Plaintiff and is
only appearing before this court under the threat, duress and
coercion of the gun barrel of the illegitimate government as is more
fully detailed in the NOTICE AND DEMAND FOR DISMISSAL FOR WANT OF
JURISDICTION OF THE COURT AND LACK OF CAUSE OF ACTION, RIGHT OF
ACTION AND STANDING OF THE PLAINTIFF. CONSTRUCTIVE NOTICE OF TREASON
CONSPIRACY AND FRAUD.
I do
hereby certify that the above is true and correct to the best of my
knowledge and belief and that my position has been correctly
translated into the language of the court by my translator and next
friend and father Michael E. DiRosa. I do hereby also reject any
other translator especially one of the treasonous conspirators of the
Louisiana Bar Association.
